A 92-year-old Cuban man is facing charges after allegedly inappropriately touching a 15-year-old neighbor last Friday in a Miami apartment complex. The elderly man, identified as Roberto Gutiérrez, was apprehended on Saturday and charged with lewd conduct involving a minor under 16, according to local media reports citing the arrest report from the Miami Police Department.
The incident specifically took place in an area encompassing parts of the Liberty City and Little River neighborhoods, though the exact address was withheld from the police report for privacy reasons.
Authorities stated that the minor reported Gutiérrez watching him as he entered his apartment around 4:20 p.m. on October 4th. Shortly thereafter, the elderly man reportedly knocked on his door, which the boy opened, mistaking him for his father. According to the report, Gutiérrez used his walker to push the door open and entered the young man's apartment.
Once inside, Gutiérrez allegedly "touched the young man on the left shoulder and arm while commenting that he was beautiful, which caused the victim to freeze," the police detailed. The authorities noted that Gutiérrez then moved towards the living room and asked the boy to sit on the couch. The minor refused, trying to get him to leave by claiming he needed to attend soccer practice.
The boy further stated that while Gutiérrez was standing between the main door and the hallway, he attempted to kiss him on the lips by leaning in, but the victim stepped back to avoid the kiss and pushed the door to force him out of the apartment.
According to the authorities, Roberto Gutiérrez later told detectives that he went to the victim's apartment that day to inquire about someone. He admitted to "touching the victim on the arm" but denied calling him beautiful or attempting to kiss him.
The elderly man was detained and taken to the Metro West Detention Center. He was released on a $2,500 bail. As of the close of this report, he no longer appears in the county jail records.
